Terms and Conditions
Please read these Terms carefully. By booking or participating in a Project You service you agree to be bound by them.
1.Introduction
Welcome to Project You, a wellness, training and recovery centre located in Harare, Zimbabwe.
These Terms and Conditions apply to all personal-training sessions, fitness classes, recovery services, packages, appointments and related services provided by Project You.
By making a booking, purchasing a package or participating in a Project You service, you confirm that you have read, understood and agreed to these Terms and Conditions.
2.Eligibility and participation
Participants must provide accurate contact and booking information.
Participants under the age of 18 must have the consent of a parent or legal guardian. Project You may require the parent or guardian to complete or approve the booking.
Project You may refuse or discontinue participation where reasonably necessary to protect the safety of the participant, the instructor or other customers.
3.Health and safety
Physical exercise, training, stretching, recovery activities and other wellness services involve inherent risks, including the possibility of discomfort, strain, falls or injury.
By participating, you confirm that:
- You are responsible for deciding whether you are physically able to participate.
- You will follow reasonable instructions given by the instructor.
- You will stop exercising and inform the instructor if you experience pain, dizziness, unusual discomfort or difficulty breathing.
- You will seek medical advice before participating where you have concerns about your health or physical ability.
Relevant health concerns should be discussed directly and privately with the instructor before participation.
Please do not submit confidential medical, injury or health information through the Project You website, booking notes, contact form or WhatsApp unless specifically requested through an appropriate private process.
Project You does not provide medical diagnosis, medical treatment or emergency medical services.
4.Assumption of risk and liability
You acknowledge and voluntarily accept the ordinary and inherent risks associated with physical activity and participation in Project You services.
You remain responsible for acting within your own capabilities, following instructions and advising the instructor when you are unable to safely perform an activity.
To the fullest extent permitted by law, Project You will not be responsible for loss, injury or damage resulting solely from:
- the ordinary inherent risks of physical activity;
- a participant’s failure to follow reasonable instructions;
- inaccurate or incomplete information provided by the participant;
- participation beyond the participant’s known physical abilities; or
- the participant’s misuse of equipment or facilities.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including any rights available to a consumer under applicable Zimbabwean law.
5.Bookings and confirmation
Advance booking is required for all classes, appointments and individual sessions.
Submitting an appointment request does not by itself guarantee that the requested time has been confirmed.
An individual appointment is confirmed once Project You changes the booking status to Confirmed and provides confirmation through WhatsApp, telephone, email or another approved communication channel.
A class place is secured when the booking is recorded as Reserved.
When a class has reached capacity, the customer may be placed on a waitlist.
Project You may decline a booking or propose a different time where:
- the requested time is unavailable;
- the instructor is unavailable;
- the facility or required room is unavailable;
- the booking conflicts with another class or appointment; or
- the service is not available at the requested time.
6.Class reservations and waitlists
Class capacity is limited.
Where a class is full, customers may join the waitlist. Joining the waitlist does not guarantee a place.
When a place becomes available, Project You may promote the next eligible person from the waitlist. The customer will be notified through the contact information provided.
Customers should not attend a class unless their place has been confirmed or reserved.
Project You may close reservations before a class begins where reasonably necessary.
7.Cancellations and rescheduling
Customers should provide at least 24 hours’ notice when cancelling or rescheduling a class or individual session.
The 24-hour period is calculated from the scheduled start time of the booking using Africa/Harare time.
Cancellation at least 24 hours before the booking
Where at least 24 hours’ notice is provided:
- a reserved package session will normally be released back to the customer’s package;
- no package session will normally be deducted; and
- any separate payment or credit will be handled according to the applicable service or package terms.
Cancellation less than 24 hours before the booking
Where less than 24 hours’ notice is provided:
- one session may be deducted from the customer’s prepaid package; or
- the full cost of the individual session or class may remain payable.
No-show
Where a customer does not attend and has not cancelled:
- one session will be deducted from an applicable prepaid package; or
- the full cost of the booking will remain payable.
Project You may waive a late-cancellation or no-show charge in exceptional circumstances.
Any waiver is discretionary and does not create an entitlement to future waivers.
Cancellation by Project You
Where Project You cancels a booking:
- no package session will be deducted;
- any reserved package session will be restored; and
- Project You will offer rescheduling, a credit or another appropriate remedy.
8.Prepaid session packages
Project You may offer prepaid packages containing a specified number of sessions.
Package details, including the number of sessions, eligible services, price and validity period, will be communicated before purchase.
Unless Project You approves otherwise:
- packages are assigned to the named customer;
- packages may not be transferred or shared;
- package sessions may only be used for eligible services;
- a customer may not reserve more sessions than remain available in the package; and
- each prepaid package is valid for two calendar months from the date of purchase. Days when Project You is closed for customer service do not count toward the two months, so the expiry date is extended automatically by those closure days.
A package balance may include:
- available sessions;
- sessions reserved for upcoming appointments;
- completed or consumed sessions;
- late-cancellation deductions;
- no-show deductions;
- bonus sessions;
- restored sessions; and
- administrative corrections.
Project You will maintain an internal record of package activity.
A session reserved against a package will be:
- consumed when the appointment is completed;
- consumed when the customer is recorded as a no-show;
- consumed following a late cancellation, unless waived; or
- released when the appointment is cancelled with sufficient notice or cancelled by Project You.
Questions or disputes regarding a package balance should be raised with Project You as soon as possible.
9.Payments
Project You currently accepts cash payments only.
Unless otherwise agreed in writing by Project You, payment is due before the class, appointment, session, consultation, massage treatment, or package begins.
All payments must be made in cash directly to Project You.
For prepaid packages, the applicable package fee must be paid in cash before the package is activated and sessions become available for use.
Project You does not currently accept EcoCash, bank transfers, card payments, online payments, or other electronic payment methods unless Project You expressly advises otherwise in writing.
Customers will be given appropriate confirmation or acknowledgement of payment where applicable.
Any refunds, credits, session restorations, or package adjustments will be handled fairly, taking into account services already provided, unused sessions, the circumstances of cancellation, Project You’s applicable cancellation rules, and any rights available under applicable law.
10.Business hours and scheduling
Current business hours and available appointment times are displayed on the Project You website or communicated by the administrator.
Business hours and class schedules may change.
Available times shown through the booking system remain subject to confirmation, instructor availability and facility availability.
11.Punctuality
Participants should arrive approximately 5 to 10 minutes before the scheduled start time.
Late arrival may reduce the available session time.
Where a late arrival materially disrupts a class or makes safe participation impractical, Project You may refuse admission without extending the class or appointment.
Customers should avoid arriving substantially earlier than requested unless prior arrangements have been made.
12.Studio etiquette
Participants are expected to:
- treat instructors and other customers respectfully;
- bring water and a sweat towel where appropriate;
- wear suitable clothing and footwear;
- use equipment only as directed;
- return used equipment to the appropriate place;
- maintain reasonable hygiene;
- avoid behaviour that disrupts a class or session; and
- comply with reasonable safety and facility instructions.
Project You may ask a participant to leave where their conduct is unsafe, abusive, disruptive or materially interferes with another customer’s experience.
13.Personal belongings
Participants are responsible for their personal belongings.
Project You is not responsible for loss, theft or damage to personal belongings unless responsibility cannot lawfully be excluded.
Customers should avoid bringing unnecessary valuables to the premises.
14.Changes to classes, instructors and services
Project You may reasonably:
- change an instructor;
- adjust a class timetable;
- change the content or format of a class;
- cancel or combine a class;
- temporarily suspend a service; or
- close the facility where necessary.
Where a material change affects a confirmed paid booking, Project You will provide an appropriate rescheduling option, credit, restoration of a package session or refund, as applicable.
15.Website and communications
Customers may receive operational communications through WhatsApp, telephone or email concerning:
- booking requests;
- confirmations;
- reminders;
- rescheduling;
- cancellations;
- class availability;
- waitlist changes; and
- package balances.
Operational communications are separate from marketing communications.
Customers are responsible for ensuring that their contact information is accurate and current.
Use of personal information is also governed by the Project You Privacy Policy.
16.Website availability
Project You aims to keep the website and booking system available, but uninterrupted access cannot be guaranteed.
A technical error, failed message or website interruption does not by itself confirm or cancel a booking.
Customers should contact Project You where they are uncertain whether a booking was successfully submitted.
17.Changes to these Terms
Project You may update these Terms and Conditions where necessary to reflect changes in services, policies, operations or legal requirements.
Material changes will be communicated through the website or another reasonable method.
Updated terms will apply from the stated effective date and will not retrospectively remove rights that have already accrued.
18.Governing law
These Terms and Conditions are governed by the laws of Zimbabwe.
The parties should first attempt to resolve any concern directly and in good faith.
Nothing in these Terms prevents a consumer from exercising any right or remedy available under applicable law.
